Welcome to BorrowStuff. These Terms of Service ("Terms") govern your use of the BorrowStuff mobile application and website (together, the "Service"), operated by BorrowStuff ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use BorrowStuff. By creating an account, you represent and warrant that you are 18 or older. If we learn that a user is under 18, we will terminate their account and delete their data.
BorrowStuff is a platform that helps friends lend and borrow personal items from each other. We facilitate connections between users — we are not a party to any lending, gifting, or sale transaction between users. All transactions are directly between the users involved. We do not own, possess, inspect, or control any items listed on the Service.
To use BorrowStuff, you must create an account using a valid phone number and email address. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. You agree to provide accurate, current information and to update it as necessary.
You may not create more than one account, impersonate another person, or use another person's account without their permission.
When you lend an item through BorrowStuff, you do so at your own discretion. When you borrow an item, you accept it as-is. BorrowStuff makes no warranty or guarantee regarding the condition, safety, fitness, or quality of any item listed on the platform. Users are responsible for communicating about item condition, pickup, return, and any terms of the loan directly with each other.
Items marked as "giveaway" are offered at the owner's discretion. Once an item is given away, the transaction is between the users involved. BorrowStuff is not responsible for the condition of items given away through the platform.
Items marked "for sale" involve payment arranged directly between users. BorrowStuff does not process, facilitate, or guarantee any payments. We are not responsible for payment disputes, non-payment, or the accuracy of listed prices. Users are solely responsible for handling payment between themselves.
You acknowledge that lending, borrowing, giving away, and selling personal property to and from other individuals involves inherent risks, including but not limited to: loss or damage to items, items not being returned, items not matching their description, personal injury from item use, and disputes between users.
You assume all risk associated with your use of the Service and your transactions with other users. BorrowStuff does not insure any items listed on or lent through the platform. We do not verify the condition or safety of items. We strongly encourage users to communicate clearly about expectations, timelines, and item condition before and during any transaction.
If you have a dispute with one or more users, you release BorrowStuff and its operators from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
You retain ownership of all content you post on BorrowStuff, including item photos, descriptions, profile information, and community content ("User Content"). By posting User Content, you grant BorrowStuff a perpetual, irrevocable, non-exclusive, royalty-free, worldwide, fully sublicensable license to use, copy, display, reproduce, distribute, and make derivative works from your User Content for the purpose of operating, promoting, and improving the Service.
You represent that you have the right to post any User Content you submit and that your content does not violate the rights of any third party.

We reserve the right to remove any content and suspend or terminate any account that violates these Terms, at our sole discretion.
BorrowStuff allows users to create and join communities. Community administrators are responsible for their communities and their members' conduct within them. BorrowStuff is not responsible for content shared within communities or interactions between community members.
Our Privacy Policy describes how we collect, use, and protect your personal data. By using the Service, you agree to the collection and use of your data as described in the Privacy Policy.
By creating an account, you consent to receive electronic communications from BorrowStuff, including push notifications, in-app notifications, and emails related to the Service (such as borrow requests, friend requests, and account updates). You can manage your notification preferences in the app's Settings screen.
To the maximum extent permitted by law, BorrowStuff and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or related to your use of the Service, including but not limited to:
In no event shall our total liability to you exceed fifty dollars ($50 USD). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify and hold harmless BorrowStuff and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your transactions with other users; (d) your violation of these Terms; or (e) your violation of any rights of a third party.
If you sell items through BorrowStuff, you are solely responsible for determining and fulfilling any tax obligations that may arise from those sales, including reporting income and collecting or remitting sales tax where required by law. BorrowStuff does not provide tax advice and does not report transactions to tax authorities on your behalf.
You may delete your account at any time from the Settings screen in the app. When you delete your account, we permanently delete all of your data as described in our Privacy Policy.
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise inappropriate. Upon termination, your right to use the Service ceases immediately.
The BorrowStuff name, logo, and all related trademarks, service marks, and trade dress are our intellectual property. You may not use them without our prior written consent. All software, design, text, and other content provided by us through the Service (excluding User Content) is owned by BorrowStuff and protected by applicable intellectual property laws.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. Any risk of using the Service is assumed by you.
We do not endorse or verify any user, item, or listing on the platform. Any interaction with other users is at your own risk.
We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. If we make material changes, we will notify you through the app or by email before the changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles, except to the extent governed by U.S. federal law. Any disputes arising from these Terms or your use of the Service that cannot be resolved informally shall be resolved in the state or federal courts located in California.
Before filing any claim, you agree to first contact us at support@borrowstuff.app and attempt to resolve the dispute informally for at least 30 days.
